The protection of individuals’ personal information is important to us. This Privacy Notice (“Notice”) is provided pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 and describes how Westlake processes the personal information of California consumers. This Notice supplements our other privacy policies and notices, including our main Privacy Notice. 
We maintain separate privacy notices for California employees and job applicants.


1. What categories of personal information do we collect and for what purposes?
When we use the term “personal information” in this Notice, we are using that term as the CCPA defines it, which generally means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. However, personal information does not include publicly available, deidentified, or aggregate consumer information (which are all defined in the CCPA).


When you interact with us, we may obtain the following categories of personal information which we use for the purposes described below.

  • Inferences drawn from the other categories of personal information we collect. 
  • Sensitive personal information, such as your driver’s license and social security number.
  • Internet or other electronic network activity information, including browsing history, search history, and information regarding interactions with our website, applications, or advertisements.
  • Geolocation data, based on your device IP address.

In addition to the purposes described above, we may use and disclose any category of personal information we collect to respond to law enforcement requests, or as otherwise required or authorized by applicable law, court order, or governmental regulations; to protect our rights and interests and those of others; to resolve any disputes; to enforce our terms and policies; and to evaluate or conduct a merger, sale, or other acquisition of some or all of our assets.


2. What are the sources from which we obtain your personal information?


We may collect the personal information identified above from the following sources:

  • Directly from you. For example, when you provide us information online, through electronic forms, over the phone, or through paper documents. Or when you make a request subject to the CCPA and we have to verify your identity in order to honor your request.
  • Automatically when visiting our websites and/or using our electronic systems. For example, via cookies and other tracking technologies.
  • Automatically when you visit our facilities. For example, CCTV footage.
  • From service providers, vendors, and suppliers, or other individuals and businesses, including vendors that support our business and operations, internet service providers, social networks and data analytics providers, as well as from other companies we do business with.
  • From our affiliated companies.
  • Created by us. For example, if we generate information or records pertaining to you, provide you with a login or user ID, or otherwise create information linked to you.

3.    How long do we retain your personal information?


We keep the categories of personal information described above for as long as necessary for the purposes described in this Notice or otherwise authorized by law. This generally means holding personal information for as long as one of the following apply: 

  • Your personal information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;
  • Your personal information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the personal information was collected; 
  • The information is reasonably required to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or 
  • We are otherwise required or permitted to keep your personal information by applicable laws or regulations. 
  • Where personal information is used for more than one purpose, we will retain it until the purpose with the latest period expires. 

4.    How do we disclose personal information?
We do not make use of automated decision-making.

We do not sell personal information or share it for cross-context behavioral advertising. We may disclose each of the categories of personal information we collect to our service providers and contractors for the following business and commercial purposes: 

  • Performing services (including processing, maintaining, or collecting personal information) on our behalf related to the purposes for which we collect each category of personal information as described above (e.g., providing communications, technical, analytical, web hosting, data storage, application support, vendor management, customer support, accounting, auditing, insurance, legal, security, or other services);
  • Ensuring security and integrity of personal information;
  • Debugging to identify and repair errors that impair existing intended functionality;
  • Short-term, transient use, including, but not limited to, non-personalized advertising; 
  • Providing advertising or marketing services on our behalf; 
  • Auditing related to ad impressions;
  • Undertaking internal research for technological development and demonstration;
  • Undertaking activities to verify or maintain the quality or safety of our products and services;
  • To comply with applicable laws and regulations;
  • For safety and security of our systems;
  • Detecting, protecting against, or addressing malicious, deceptive, fraudulent, or illegal activity.

5.    What are my rights with regard to my personal information?


You have the right to make certain requests, described below, concerning your personal information. Before we act on any such requests, we must be able to reasonably verify that you have made the request about your own personal information. We will attempt to verify that you are the consumer whose information you are requesting by attempting to match the identifying information you provide to the personal information we have on file. You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed. An authorized agent may submit a request on your behalf using the email address or toll-free number listed below. We will not discriminate against you for exercising any of your privacy rights under the CCPA.

Please provide us enough information to verify your identify. We will use information you provide to us to verify your request. If we cannot initially verify your identity, we may request additional information to complete the verification process, such as, for example, a copy of your driver’s license and/or a recent utility or credit card bill. 


You can designate an agent to make a request on your behalf by either: (1) having your agent send us a letter, signed by you, certifying that the agent is acting on your behalf and showing proof that they are registered with the California Secretary of State; or (2) by you and the agent executing and sending us a notarized power of attorney stating that the agent is authorized to act on your behalf. Please note that we may still require you to verify your identity before we process a request submitted by your agent.


You Have The Right to Know What Personal Information We Have Collected About You.
You have the right to request:
(1)    The categories of personal information we have collected about you, including: 

  • The categories of sources from which the personal information was collected;
  • Our business or commercial purposes for collecting or disclosing personal information;
  • The categories of recipients to which we disclose personal information; and
  • The categories of personal information that we disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of personal information;

(2)    The specific pieces of personal information we have collected about you.


You Have The Right to Request That We Delete Your Personal Information.


You have the right to request that we delete personal information that we collected from you, subject to certain exceptions.


You Have The Right to Request That We Correct Inaccurate Personal Information.


If you believe that personal information we maintain about you is inaccurate, you have the right to request that we correct that personal information.


You Have The Right to Request That We Limit The Use of Sensitive Personal Information.
We only use your sensitive personal information for limited and legitimate purposes, such as providing you with the services you requested. In any case you can contact us if you have questions or concerns pertaining this personal information.


You Have The Right to Opt Out of Sales and Sharing of Personal Information


We do not sell personal information, nor do we share it for cross-context behavioral advertising. Nonetheless, this does not prevent you from exercising your right under the CCPA to request that we not sell your personal information.
